1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Plasmiro, a brand of The Nelson M Group LLC ("Plasmiro," "we," "us"). They govern your use of plasmiro.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Disagree with any part of them? Then please do not use the Services.

2What Plasmiro is, and is not

Plasmiro is an information service. We publish general, plain-language information about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We do not give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we do not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other third-party partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Plasmiro, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

3Eligibility

The Services are open to people who are at least 18, are located in the United States, and can legally enter a binding contract. Please submit details only about yourself, or about another person who has authorized you to share them.

4Your information and accuracy

The information you give us must be accurate and current, and you agree to correct it when it changes. Provide only a mobile number that belongs to you or that you are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

By opting in, you agree that we may reach you by email and, where you check the relevant boxes, by automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join at 877-289-1636, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at support@plasmiro.com or by phone at 877-289-1636. Also, please message HELP to any of our numbers to receive help or information about the number.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

The following are prohibited: (a) submitting false or misleading details, or information about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) belong to third parties. We endorse no product, plan, or provider, and we take no responsibility for the conduct, content, or outcomes of any third party. Your relationship with any doctor or study team is between you and them.

9Intellectual property

The Services, including the Plasmiro name, logo, text, graphics, and design, are owned by us or our licensors and covered by intellectual property laws. Your license to view and use the Services is limited, revocable, non-exclusive, and non-transferable, and is for personal, non-commercial purposes. Site photographs are used under their respective free-use licenses.

10Disclaimers

The services and all content are given "as is" and "as available" without warranties of any kind, whether express or implied, for example implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Plasmiro does not provide financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11Limitation of liability

To the fullest extent permitted by law, Plasmiro and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Because some jurisdictions restrict certain limitations, portions of the above may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12Indemnification

You agree to hold The Nelson M Group LLC, its affiliates, and its personnel harmless, and to indemnify them, for claims, damages, and expenses (sensible attorneys' fees included) arising from your violation of these Terms, from misuse of the Services, or from giving a phone number or other information that you were not authorized to offer.

13Disputes, governing law, and arbitration

Informal resolution first. Before filing a claim, please contact us at support@plasmiro.com and give us a 30-day window to try to settle it.

Binding arbitration. Except for small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Plasmiro or The Nelson M Group LLC arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in your county of residence or by video or phone, at your choice. The arbitrator may award the same individual relief as a court, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. You and Plasmiro each waive, to the extent the law permits, any right to bring claims as a plaintiff or class member in a class, collective, or representative action; claims may be brought on an individual basis only.

Opt-out. You have 30 days after first accepting these Terms to opt out of arbitration, which you do by emailing support@plasmiro.com using the subject line "Arbitration Opt-Out" and giving your name and mobile number.

Governing law. These Terms are subject to the Federal Arbitration Act and to the law of the state of The Nelson M Group LLC's principal place of business, disregarding conflict-of-law rules. Other than as the arbitration clause supplies, courts of that state, state and federal, have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Access may be suspended or terminated by us at our discretion, for example for violations of these Terms. Sections that by nature are intended to survive, including disclaimers, limitation of liability, indemnification, and disputes, remain in force after termination.

15Changes

Updates to these Terms will be posted with a new "Last updated" date. Using the Services after the effective date means accepting the updated Terms. If a change is material, we will notify you as mandated by law.

16General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
